The Ministry of Commerce and Industry (MoCI) on September 16, 2026, notified the Initiation of an anti-circumvention investigation concerning alleged circumvention through Malaysia, Japan and Thailand of the anti-dumping duty imposed on imports of “Chlorinated Polyvinyl Chloride (CPVC) Resin.
The following has been stated:
• The Directorate General of Trade Remedies (DGTR) has initiated an anti-circumvention investigation concerning Chlorinated Polyvinyl Chloride (CPVC) Resin, whether or not further processed into a compound, currently subject to anti-dumping duty on imports from China PR and Korea RP. The investigation follows an application by DCW Limited, Epigral Limited, and Lubrizol Advanced Materials India Pvt. Ltd., alleging that exporters are circumventing the existing anti-dumping duty through exports from Japan, Malaysia, and Thailand. The investigation specifically covers exports by EBC Corporation (Japan), Sasia Chlorine Polymers Sdn. Bhd. (Malaysia) and Sekisui Specialty Chemicals (Thailand) Co. Ltd.
• The investigation has been initiated under Section 9A(1A) of the Customs Tariff Act, 1975 read with Rules 25 and 26 of the Anti-Dumping Rules, 1995, based on prima facie evidence of a changed pattern of trade, increased imports from the three subject countries, and alleged dumping. The investigation period is April 1, 2025 to March 31, 2026, and the injury period covers 2022-23 to the POI. Interested parties shall register and submit information through the DGTR SETU Portal, with questionnaire responses due within 37 days from the date of the information request. Confidential submissions shall be accompanied by non-confidential versions and adequate justification for confidentiality; comments on confidentiality claims may be submitted within 7 days. Non-cooperation may result in findings based on available facts.
